Note 1
(1) Bukhari in The Book of Drinking—As cited in Ashi’at al-Lama’at. (2) "A slave who possesses wealth"—The Malikis used this to argue that slaves can own property. Ahmad and Al-Shafi’i (in an earlier opinion) held that a slave owns property if the master permits it. Abu Hanifah and Al-Shafi’i (later) maintained that slaves cannot own property; the possessive pronoun here denotes restricted use (tamlik). (3) "The wealth belongs to the seller unless the buyer stipulates otherwise"—This is agreed upon, as mentioned in Rahmat al-Ummah.
