(1) The statement: “Prohibited buying spoils until they are divided”: In (Al-Hidayah) and (Al-Binayah): Selling spoils before division in the land of war is impermissible, as ownership is not established. Shafi‘i disagrees, saying it is permissible, as ownership begins with capture. Per Hanafis, ownership is not established until secured in the land of Islam.

(١) قوله: نهى رسول الله صلي الله عليه واله وسلم عن شراء المغانم حتى تقسم: قال في (الهداية) و(البناية): لا يجوز بيع الغنائم قبلالقسمة في دار الحرب؛ لأنه لا ملك قبلها، وفيه خلاف الشافعي، فعنده يجوز؛ لأن سبب الملك عنده الاستيلاء.وقد بيَّنًا الأصل أي إن الملك للغانمين قبل الإحراز بدار الإِسلام لا يثبت عندنا، وعنده يثبت.
