Huzayl ibn Shurahbil narrated: Abu Musa was asked about a daughter, a granddaughter, and a sister. He said: The daughter gets half, and the sister gets half. Go to Ibn Mas’ud, and he will agree with me. Ibn Mas’ud was asked and informed of Abu Musa’s statement. He said: I would have gone astray and not been among the guided if so. I judge in it as the Prophet (ﷺ) judged: the daughter gets half, the granddaughter one-sixth to complete two-thirds, and what remains is for the sister. We came to Abu Musa and informed him of Ibn Mas’ud’s statement. He said: Do not ask me as long as this expert is among you.

ف: واضح ہو کہ اس حدیث شریف میں وراثت کی تقسیم کا جو مسئلہ ہے وہ چھ حصوں میں ہوگا۔ تین حصے بیٹی کو، ایک حصہ پوتی کو اور دو حصے بہن کو ملیں گے۔ اس کی وجہ یہ ہے کہ جب ایک لڑکی کے ساتھ پوتیاں ہوں یا ایک ہی پوتی ہو تو ان سب کو ایک حصہ اور نصف بیٹی کو مل کر دو تہائی کا تکملہ ہو جائے گا۔ اور بیٹیوں کے ساتھ عصبہ ہو جاتی ہیں، یعنی بیٹیوں کے حصہ سے جو بچ رہے وہ بہنوں کو مل جاتا ہے۔ جمہور علماء کا اس مسئلہ میں حضرت ابن مسعود رضی اللہ عنہ کے فتویٰ پر عمل ہے (حاشیہ مشکاۃ12)
