The Chapter on What is Permissible to Eat and What is Prohibited

Zujajat al-Masabih 4030Volume 3

English

Abu al-Zubayr, from Jabir (may Allah be pleased with him), narrated: The Messenger of Allah (ﷺ) said: “Eat what the sea casts out or leaves behind; do not eat what dies in it and floats.”2 [Narrated by Abu Dawud and Ibn Majah] Muhyi al-Sunnah said: Most consider it a stopped narration (mawqoof) on Jabir. Ali al-Qari said: This does not harm, as such a mawqoof narration has the ruling of a marfoo’ (prophetic) one.

Note 2

Do not eat what dies in it and floats

(2) The statement: “Do not eat what dies in it and floats”: In “Sharh al-Sunnah,” scholars differed on floating fish. Some companions and successors, including Malik and al-Shafi’i, permitted it, while others, including Jabir, Ibn Abbas, and Abu Hanifah’s companions, disliked it.
