Abu Bakrah (may Allah be pleased with him) narrated that the Prophet (ﷺ) said: “When two Muslims bear arms against each other, they are on the brink of Hellfire. If one kills the other, both enter it.” In another narration from him: “When two Muslims meet with their swords, the killer and the killed are in Hellfire.” I said: “O Messenger of Allah, the killer, but why the killed?” He said: “Because he was eager to kill his companion.”

Note 2

Because he was eager to kill his companion

(2) His statement: “Because he was eager to kill his companion”: Ibn Al-Malik said: This indicates that intent for a forbidden act is accountable, even if both intended to kill the other, not to defend themselves. If one’s intent was defense and he had no choice but to kill, he is not accountable, as it is legally permitted. So it is in (Al-Mirqat). In (Radd al-Muhtar): The narration “When two Muslims meet with their swords, the killer and the killed are in Hellfire” applies to fighting out of zeal or tribalism, as occurs between people of two villages or neighborhoods, or for worldly gain or power.
