Ruwayfi‘ ibn Thabit (may Allah be pleased with him) narrated: The Prophet (ﷺ) said: “Whoever believes in Allah and the Last Day should not ride an animal from the Muslims’ spoils 3 and return it after wearing it out, nor wear a garment from the Muslims’ spoils and return it after wearing it out.”

٣٩٤٠-وَعَنْ رُوَيْفِعِ بْنِ ثَابِتٍ رضي الله عنه أَنَّ النَّبِيَّ ﷺ قَالَ: (مَنْ كَانَ يُؤْمِنُ بِاللَّهِ وَالْيَوْمِالْآخِرِ فَلَا يَرْكَبُ3 دَابَّةً مِنْ فَيْءِ الْمُسْلِمِينَ، حَتَّى إِذَا أَعْجَفَهَا رَدَّهَا فِيهِ، وَمَنْ كَانَ يُؤْمِنُ بِاللهِ وَالْيَوْمِ الْآخِرِ فَلَا يَلْبَسْ قَوْبًا مِنْ فَيْءٍ الْمُسْلِمِينَ، حَتَى إِذَا أَخْلَقَهُ رَدَّهُ فِيهِ). رَوَاهُ أَبُوْ دَاوُدَ.

نے ارشاد فرمایا جو کوئی اللہ اور آخرت کے دن پر ایمان رکھتا ہے تو وہ مسلمانوں کے مال غنیمت کے کسی
بھی جانور پر سواری نہ کرے 19؎ کہ وہ اس کو دبلا کر کے واپس کرے اور مسلمانوں کے مال غنیمت
میں سے کوئی کپڑا نہ پہنے کہ اس کو پرانا کر کے واپس کرے۔ (ابوداؤد)

(3) The statement: “Should not ride an animal, etc.”: This applies when not needed. If needed, e.g., if his horse dies in battle and he takes an enemy’s horse to fight, or wears clothes due to cold, it is permissible. When the need ends, it is returned to the spoils. As in (Badhl al-Majhud).

(٣)قوله: فلا يركب دابة إلخ: هذا محمول على ما إذا لم يحتج إليه، وأما إذا احتاج إليه كما إذا هلك فرسه في المعركة،فأخذ فرس العدوّ يقاتل عليها، وكذلك الثياب إذا أخذه البرد مثلًا يجوز لبسه، فإذا انقضت حاجته ردَّها في الغنيمة.كذا في (بذل المجهود).
