٣٢٧٣ وَعَنْ جَابِرٍ(رضي الله عنه) قَالَ: نَهَى رَسُولُ اللهِ ﷺ عَنِ الْمُخَابَرَةِ وَالْمُحَاقَلَةِ وَالْمُزَابَنَةِ. وَالْمُحَاقَلَةُ: أَنْ يَبِيعَ الرَّجُلُ الزَّرْعَ بِمِائَةِ فَرَقٍ حِنْطَةٍ. وَالْمُزَابَنَةُ: أَنْ يَبِيْعَ التَّمَرَ فِي رُؤُوسِ النَّخْلِ بِمِائَةِ فَرَقٍ وَالْمُخَابَرَةُ:1 كَرَاءُ الْأَرْضِ بِالثُّلُثِ وَالرُّبُعِ. رَوَاهُ مُسْلِمٌ.
وَرَوَى الْجَمَاعَةُ إِلَّا النَّسَائِيُّ عَنِ ابْنِ عُمَرَ أَنَّ النَّبِيَّ ﷺ عَامَلَ أَهْلَ خَيْبَرَ بِشَطْرِ مَا يَخْرُجُ مِنْهَا مِنْ ثَمَرٍ أَوْ زَرْعٍ.

(1) The statement: "Mukhabara" – This type of sharecropping is invalid according to Abu Hanifah, making the hadith evidence against it. However, his two companions validated it, and this is the fatwa given due to people’s need for it and based on the narration that the Prophet (ﷺ) contracted with the people of Khaybar for half the produce. This is taken from Al-Maraqi and Al-Hidayah.
