Burayda (may Allah be pleased with him) narrated: Ma‘iz ibn Malik came to the Prophet (ﷺ) and said: O Messenger of Allah, purify me. He said: Woe to you, return, seek Allah’s forgiveness, and repent to Him. He returned, not far, then came and said: O Messenger of Allah, purify me. The Messenger of Allah (ﷺ) said the same. At the fourth time, the Messenger of Allah (ﷺ) said: From what should I purify you? He said: From adultery. The Messenger of Allah (ﷺ) said: Is he insane? He was informed he was not insane. He said: Did he drink wine? A man stood, smelled him, and found no smell of wine. He said: Did you commit adultery? He said: Yes. He ordered him to be stoned. They lingered on this for two or three days. Then the Messenger of Allah (ﷺ) came and said: Seek forgiveness for Ma‘iz ibn Malik, for he has repented with a repentance that, if divided among a community, would suffice them. Then a woman from Ghamid of Azd came and said: O Messenger of Allah, purify me. He said: Woe to you, return, seek Allah’s forgiveness, and repent to Him. She said: Do you want to turn me away as you turned away Ma‘iz ibn Malik? I am pregnant from adultery. He said: Is it you? She said: Yes. He said: Until you deliver what is in your womb. An Ansari man sponsored her until she delivered. He came to the Prophet (ﷺ) and said: Al-Ghamidiyya has delivered. He said: Then we will not stone her and leave her child small with no one to nurse him. An Ansari man stood and said: Her nursing is upon me, O Prophet of Allah. He stoned her. In another narration: He said to her: Go until you give birth. When she gave birth, he said: Go, nurse him until you wean him. When she weaned him, she brought the child with a piece of bread in his hand and said: O Prophet of Allah, I have weaned him, and he eats food. He handed the child to a Muslim man, then ordered for her, and a pit was dug to her chest, and he ordered the people, and they stoned her. Khalid ibn al-Walid came with a stone, threw it at her head, and blood splattered on his face, so he cursed her. The Prophet (ﷺ) said: Stop, O Khalid, by Him in whose hand is my soul, she has repented with a repentance that, if a tax collector repented with it, he would be forgiven. Then he ordered for her, prayed over her, and she was buried. .

Note 1
(1) The statement: Seek forgiveness for Ma‘iz ibn Malik, for he has repented with a repentance that, if divided among a community, would suffice them: If asked: What is the benefit of saying: Seek forgiveness for Ma‘iz? The answer: The benefit is in Allah’s saying: When Allah’s victory comes [Al-Nasr: 1] to And I seek His forgiveness [Al-Nasr: 3], and Indeed, We have granted you a clear victory that Allah may forgive you [Al-Fath: 1-2]. The second seeks further forgiveness and advancement in ranks and steadfastness, as in Allah’s saying: Seek forgiveness from your Lord, then repent to Him [Hud: 90]. So it is in Al-Mirqat.
Note 2
(2) The statement: He returned, not far: Meaning a return not far, implying an absence not far. So it is in Al-Mirqat.
(2) The statement: Until you deliver what is in your womb: This indicates that a pregnant woman is not punished until she delivers, to avoid harming the innocent due to the guilty, whether the punishment is for Allah or people. So it is in Al-Mirqat and Al-Hidaya.
Note 3
(3) The statement: Then he came, etc.: If asked: Why did Ma‘iz and al-Ghamidiyya not suffice with repentance, which achieves their goal of removing sin, yet insisted on confession and were stoned? The answer: Purification by punishment is certain, especially in the Prophet’s (ﷺ) presence, while repentance may not be sincere or meet its conditions. So it is in Al-Mirqat. (4) The statement: Did he drink wine? A man stood, smelled him, and found no smell of wine: Al-Nawawi said: Malik’s followers and most Hijazis argued that one with the smell of wine is punished, even without evidence of drinking or confession. Al-Shafi‘i, Abu Hanifa, and others say punishment requires evidence of drinking or confession, and this hadith does not support Malik’s followers.
(3) The statement: I have weaned him, and he eats food: This indicates that stoning a pregnant woman is delayed until her child is independent, if no one can raise it, to protect the child from loss. Abu Hanifa said in one view, supported by this narration. In another view, a pregnant woman who commits adultery is not punished until she delivers, supported by the first narration. Taken from Al-Mirqat and Al-Hidaya.
Note 4
(4) The statement: A pit was dug to her chest: This may have been without his (ﷺ) order. Thus, the author of Al-Hidaya said: Omitting the pit does not harm, as the Prophet (ﷺ) did not order it. It appears it was by his order or approval, so digging is recommended for her. So it is in Al-Mirqat and Al-Durr al-Mukhtar.
