Al-Bara ibn Azib (may Allah be pleased with him) narrated: The Prophet (ﷺ) made a treaty with the polytheists 1 on the Day of Hudaybiyyah on three terms: to return to them any polytheist who came to him, not to return Muslims who went to them, and to enter Makkah the next year for three days, carrying only sheathed weapons like swords and bows. Abu Jandal came in chains, and he returned him to them.

٣٩٦٥ - وَعَنِ الْبَرَاءِ بْنِ عَازِبٍ قَالَ: صَالِحَ 1 النَّبِيُّ صلي الله عليه واله وسلم المُشْرِكِيْنَ يَوْمَ الحُدَيْبِيَةِعَلَى ثَلَاثَةِ أَشْيَاءَ: عَلَى أَنَّ مَنْ أَتَاهُ مِنَ الْمُشْرِكِينَ رَدَّهُ إِلَيْهِمْ، وَمَنْ أَتَاهُمْ مِنَ الْمُسْلِمِينَ لَمْ يَرُدُّوهُ، وَعَلَى أَنْ يَدْخُلَهَا مِنْ قَابِلٍ، وَيُقِيمَ بِهَا ثَلَاثَةَ أَيَّامٍ، وَلَا يَدْخُلَهَا إِلَّا بِجُلبَّانِ السِّلَاحِوَالسَّيْفِ وَالْقَوْسِ وَنَحْوِهِ. فَجَاءَ أَبُو جَنْدَلٍ يَحْجُلُ فِي قُيُودِهِ فَرَدَّهُ إِلَيْهِمْ. مُتَفَقُ عَلَيْهِ.

حدیبیہ کے دن مشرکین سے تین باتوں پر مصالحت فرمائی 8
(1) آپ کے پاس جو بھی مشرکین کے پاس سے آئے گا آپ صلی اللہ علیہ وسلم اس کو ان کی
طرف لوٹا دیں گے۔
(2) اور جو مسلمان ان کے پاس چلے جائے اس کو وہ واپس نہیں کریں گے۔
(3) اور یہ کہ آپ صلی اللہ علیہ وسلم اس (مکہ) میں آئندہ سال داخل ہوں گے اور وہاں تین
دن قیام فرمائیں گے اور آپ صلی اللہ علیہ وسلم اس میں داخل نہیں ہوں گے مگر ہتھیار کو، تلوار کو اور میان
اور اس جیسی چیزوں کو تھیلے میں چھپائے ہوئے داخل ہوں گے۔
پس آپ صلی اللہ علیہ وسلم کے پاس ابوجندل اپنی بیڑیوں میں لڑکھڑاتے ہوئے آئے تو آپ
صلی اللہ علیہ وسلم نے انہیں ان کی طرف واپس کر دیا۔ (بخاری و مسلم)۔

(1) The statement: “The Prophet (ﷺ) made a treaty with the polytheists…”: Ibn al-Humam said: If the enemy besieges Muslims and seeks a treaty with Muslims paying them wealth, the leader must not agree, as it involves humiliation, and a believer must not be humbled, per: “To Allah belongs honor, and to His Messenger and the believers” [Qur’an 63:8]. An exception is if the leader fears destruction for himself and Muslims, then it is permissible.

(١) قوله: صالح النبي وَا ليه المشركين يوم الحديبية على ثلاثة أشياء إلخ: قال الشيخ ابن الهمام: ولو حاصر العدوالمسلمين وطلبوا الموادعة على مال يدفعه المسلمون إليهم لا يفعله الإمام؛ لما فيه من إعطاء الدنية أي النقيصة،وليس للمؤمن أن يذل نفسه فالعزة خاصية الإيمان قال تعالى: (وَلِلَّهِ الْعِزَّةُ وَلِرَسُولِهِ وَلِلْمُؤْمِنِينَ) (المنافقون: ٨) إلاإذا خاف الإمام الهلاك على نفسه والمسلمين، فلا بأس.
